TERMS OF SERVICE

Terms of Service

Effective date: 30 July 2026

These Terms of Service govern your use of the Flair website and any purchases made through it.

In these terms, “Flair”, “we”, “us” and “our” refer to Flair NZ Limited. “You” and “your” refer to anyone who visits the website or purchases products from us.

By accessing this website, creating an account or placing an order, you agree to these Terms of Service. Please do not use the website if you do not agree to them.

1. Online Store Terms

You must be legally able to enter into a binding agreement to place an order through our website.

You must not use our website or products for any unlawful, fraudulent or unauthorised purpose.

You must not attempt to damage, disrupt or gain unauthorised access to the website, its systems or the information held through it.

2. Products and Product Information

We aim to describe and display our products as accurately as possible. However:

Colours may vary slightly depending on your screen or device.
Product measurements may be approximate.
Packaging may differ from the images shown.
Handmade or natural products may have minor variations in colour, texture, shape or finish.

These variations are not necessarily faults and may form part of the product’s individual character.

We may update product descriptions, prices, images and availability at any time.

3. Product Availability

All products are subject to availability.

Adding a product to your cart does not reserve it. A product is only allocated to your order once your order has been accepted and payment has been successfully processed.

Although our inventory is regularly updated, an item may occasionally sell out before our systems have updated. This may be more likely where stock is shared between our online and physical retail locations.

When an ordered product is unavailable, we will contact you and offer an appropriate alternative, store credit or a refund for the unavailable item.

4. Prices

Unless otherwise stated, all prices displayed on the website are in New Zealand dollars and include GST.

Delivery charges are calculated separately and displayed during checkout before you complete your order.

International customers may be responsible for customs duties, taxes, tariffs, brokerage charges or other fees imposed by the destination country. These charges are not included in our prices or delivery costs and are the customer’s responsibility.

We may change our prices at any time. Price changes will not affect orders that we have already accepted.

5. Orders

Placing an order is an offer to purchase products from us. Your order is not accepted until we have:

Received successful payment;
Confirmed that the products are available; and
Sent you an order confirmation or dispatch confirmation.

We may refuse or cancel an order when:

A product is unavailable;
The price or product information contains an obvious error;
Payment cannot be authorised;
We reasonably suspect fraud or unauthorised activity;
Delivery cannot be completed to the address provided; or
The order appears to be intended for unauthorised resale.

When we cancel an order after payment has been made, we will refund the affected amount to the original payment method.

6. Payments

Payment must be made through one of the payment methods available at checkout.

You confirm that you are authorised to use the payment method provided and that all payment and billing information is accurate.

Payment services may be provided by third-party payment processors. We do not generally receive or store your complete payment card details.

Where a third-party payment provider offers instalments or deferred payment, its separate terms, eligibility requirements and fees may apply.

7. Discount Codes and Promotions

Discount codes must be entered at checkout and cannot generally be applied after an order has been placed.

Unless otherwise stated:

Only one discount code may be used per order.
Discount codes cannot be exchanged for cash.
Discount codes cannot be used to purchase gift cards.
Promotions cannot be combined.
Discounts do not apply to delivery charges.
Promotional offers are available for the stated period or while stocks last.

We may amend, suspend or withdraw a promotion where reasonably necessary, including when there has been an error, misuse or unauthorised distribution of a discount code.

8. Gift Cards

Gift cards are redeemable only through the sales channels identified when they are issued.

Gift cards:

Cannot be exchanged for cash;
Cannot be used to purchase another gift card;
Must be kept secure by the recipient; and
May not be replaced if lost, stolen or used without permission, except where required by law.

Any expiry date or specific conditions will be stated when the gift card is issued.

9. Delivery

Delivery timeframes are estimates only. Although we will take reasonable care to dispatch orders promptly, delays may occur due to couriers, weather, public holidays, stock issues, customs processes or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by you.

Risk in the products passes to you when the order is delivered to the nominated delivery address, unless applicable law provides otherwise.

Your rights in relation to delivery are also protected by the Consumer Guarantees Act where it applies. New Zealand consumer protections generally apply to online purchases in the same way that they apply to purchases made in person.

10. Authority to Leave

When you authorise a courier to leave a parcel unattended, you accept the risk of loss, theft or damage after it has been left in accordance with those instructions.

We may still assist you with a courier enquiry, but we cannot guarantee replacement or reimbursement where tracking confirms the parcel was delivered as authorised.

Nothing in this section limits any rights you may have under applicable consumer law.

11. Returns, Exchanges and Faulty Products

Returns and exchanges are governed by our separate Returns Policy, which forms part of these Terms of Service.

Nothing in these terms excludes, restricts or modifies your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other rights that cannot legally be excluded.

Products supplied to New Zealand consumers must meet minimum guarantees, including being of acceptable quality, fit for purpose and consistent with their description. Remedies may include repair, replacement or refund, depending on the circumstances.

Change-of-mind returns are not a legal requirement and are offered only in accordance with our Returns Policy.

Sale and discounted products remain protected by consumer law when they are faulty, unsafe, incorrectly described or otherwise fail to meet the required legal guarantees.

12. Consumer Law

We comply with New Zealand consumer law.

The Fair Trading Act applies to the promotion and sale of products, including advertising, pricing, product descriptions and online sales practices. Businesses must not mislead consumers or make false representations about products, prices or availability.

These terms should not be interpreted as excluding any statutory right or remedy available to you.

13. Business Purchases

When you purchase products for personal, domestic or household use, the Consumer Guarantees Act will generally apply.

When products are acquired for business purposes, we may agree in writing that the Consumer Guarantees Act does not apply, but only where it is fair and reasonable for the parties to contract out of the Act and the legal requirements for doing so have been met.

14. Website Information

The information on this website is provided for general product and shopping purposes.

We take reasonable care to keep information accurate, but we do not guarantee that the website will always be complete, current, uninterrupted or free from errors.

We may correct errors and update website content without notice.

We will not rely on a term that is unfair, excessively one-sided or inconsistent with New Zealand law. Standard-form consumer contracts are subject to the unfair contract term provisions of the Fair Trading Act.

15. Third-Party Links and Services

Our website may include links to third-party websites, social media platforms, payment providers, delivery companies or other services.

These services are operated independently from Flair NZ Limited. We are not responsible for their content, security, availability or practices.

Your use of third-party services may be governed by separate terms and privacy policies.

16. Reviews and User-Submitted Content

When you submit a review, photograph, comment or other content to us, you confirm that:

The content is your own or you have permission to provide it;
It is accurate and not misleading;
It does not infringe another person’s rights;
It is not unlawful, defamatory, abusive or offensive; and
It does not contain malicious software or unauthorised promotional material.

You grant Flair NZ Limited a non-exclusive, royalty-free permission to use, reproduce and display that content in connection with our website, social media, advertising and promotional activities.

We may remove submitted content where we reasonably consider it inappropriate, misleading or unlawful.

17. Intellectual Property

All website content, including the Flair name, logos, graphics, photographs, text, layout and design, is owned by or licensed to Flair NZ Limited unless otherwise stated.

You may view and use the website for personal shopping purposes.

You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit our content without prior written permission.

Product names, logos and trademarks belonging to other brands remain the property of their respective owners.

18. Prohibited Uses

You must not use this website:

For unlawful or fraudulent activity;
To infringe intellectual property or privacy rights;
To submit false or misleading information;
To transmit viruses or malicious code;
To collect information about others without authority;
To interfere with the website’s operation or security;
To place orders using stolen or unauthorised payment information; or

20. Limitation of Liability

To the maximum extent permitted by law, Flair NZ Limited will not be liable for indirect, incidental or consequential losses arising from your use of the website or products.

Where we are legally entitled to limit our liability, our total liability relating to an order will not exceed the amount you paid for the affected product.

These limitations do not apply where liability cannot legally be excluded or limited, including rights and remedies available under the Consumer Guarantees Act.

21. Events Outside Our Control

We will not be responsible for a delay or failure caused by an event outside our reasonable control, such as:

Natural disasters or severe weather;
Fire or flooding;
Transport or courier disruption;
Industrial action;
Government action;
Power, telecommunications or internet failure;
Cyberattacks;
Supplier disruption; or
Public-health emergencies.

We will take reasonable steps to minimise the impact and fulfil affected orders where practicable.

22. Changes to These Terms

We may update these Terms of Service from time to time.

The version published on the website when you place an order will generally apply to that purchase. Any updated effective date will be shown at the top of this page.

23. Severability

When any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

24. No Waiver

When we do not immediately enforce a right under these terms, this does not mean that we have waived that right.

25. Governing Law

These Terms of Service are governed by the laws of New Zealand.

Any dispute will be subject to the jurisdiction of the New Zealand courts, without limiting any right a consumer may have to bring a claim through the Disputes Tribunal or another appropriate body.
